Terms and Conditions for Online Payment

A) Privacy Policy

NPS OMR respects the privacy of individuals who access the information and use the services offered through its website. Any personally identifiable information provided by the User is protected and will not be disclosed to any third party without the User’s prior consent, as outlined in this Privacy Policy.

This Privacy Policy outlines how NPS OMR treats personally identifiable information that it collects when a User accesses the NPS OMR website. NPS OMR does not collect any unique information about the User (such as name, email address, age, or gender) unless it is knowingly provided by the User. From time to time, NPS OMR may send emails or other communications to inform the User about its services, features, functionality, and content or to request voluntary information. However, NPS OMR may release specific personal information about the User if required to do so under the following circumstances:

  • To comply with a valid legal process such as a search warrant or court order, or any other judicial scrutiny.
  • If the User’s actions on the NPS OMR website violate the Terms of Service or any of the guidelines for specific services.
  • To protect or defend NPS OMR’s legal rights or property, its website, or its Users.
  • To investigate, prevent, or take action regarding illegal activities, suspected fraud, or potential threats to the security and integrity of the NPS OMR website or offerings.

B) General Terms and Conditions for Online Payments

Once a User accepts these Terms and Conditions, they may register and use the Services. The User can either register on the NPS OMR website or enter their roll number to pay their dues or fees as specified by NPS OMR. The rights, obligations, and undertakings of NPS OMR are subject to the laws in force in India and any directives or procedures of the Government of India. Nothing in these Terms and Conditions shall limit NPS OMR’s right to comply with any law enforcement agency’s request or requirement relating to any User’s use of the website or the information provided to or gathered by NPS OMR in connection with such use.

If any part of these Terms and Conditions is deemed invalid or unenforceable under applicable law, the invalid or unenforceable provision will be replaced by a valid, enforceable provision that most closely matches the original provision’s intent. The remainder of the Terms and Conditions will remain in effect.

These Terms and Conditions represent the entire agreement between the User and NPS OMR, superseding all prior or contemporaneous communications and proposals, whether electronic, oral, or written. A printed version of these Terms and Conditions and any notice given electronically will be admissible in judicial or administrative proceedings related to these Terms and Conditions to the same extent as other business documents and records originally generated and maintained in printed form.

Refund for Chargeback Transactions: If there is any claim for a chargeback by the User for any reason, the User must immediately contact NPS OMR with their claim details and request a refund directly from NPS OMR. Any such refund (if applicable) will be processed by NPS OMR using a method it deems appropriate. Users should not raise refund or chargeback claims with the Payment Service Provider(s), as such claims will not be entertained.

Charge Back is defined as an approved and settled credit card or net banking transaction that is subsequently refused, debited, or charged back to the merchant account by the acquiring bank or credit card company for any reason, including bank fees, penalties, and other related charges.

Refund for Fraudulent/Duplicate Transactions: Users should contact NPS OMR directly for any issues related to fraudulent transactions or misuse of card/bank details by unauthorized individuals. NPS OMR will address such issues according to its policies and rules.

Server Slowdown/Session Timeout: If the website or the Payment Service Provider’s webpage experiences issues such as “slow down,” “failure,” or “session timeout,” the User should verify whether their bank account has been debited before initiating a second payment. If the bank account has been debited, the User should not make another payment and should contact NPS OMR to confirm the payment. If the account has not been debited, the User may initiate a new transaction. The Payment Gateway Service Provider will not be responsible for any such duplicate or fraudulent transactions, and no claims should be made against them.

C) Limitation of Liability

NPS OMR provides this Service as a convenience. NPS OMR expressly disclaims any liability arising from the provision of this Service. The User acknowledges and agrees that they are solely responsible for their conduct, and NPS OMR reserves the right to terminate the User’s access to the Service without prior notice.

NPS OMR and/or the Payment Service Providers are not liable for any inaccuracies, errors, delays, omissions, or interruptions in the data, information, or messages related to the Service. NPS OMR and/or the Payment Service Providers, including their officers, employees, and agents, are not liable for any direct, indirect, incidental, special, or consequential damages, including punitive or exemplary damages, arising from the provision or inadequacy of the Services, unauthorized access or alteration of data transmissions, or suspension or termination of the Services.

NPS OMR and the Payment Service Provider(s) assume no liability for any monetary or other damages suffered by the User due to:

  • Delays, failures, interruptions, or corruption of data transmitted in connection with the Payment Gateway or related Services.
  • Any interruptions or errors in the operation of the Payment Gateway.

The User agrees to indemnify and hold harmless the Payment Service Provider(s), NPS OMR, and their respective officers, directors, agents, and employees from any claims or actions arising from or related to the use of the Services.

The User agrees that NPS OMR or any of its employees will not be held liable for any loss or damages resulting from the User’s reliance on the information provided on the website or any failure to comply with these Terms and Conditions due to circumstances beyond NPS OMR’s reasonable control.

D) Miscellaneous Conditions

Any waiver of NPS OMR’s rights under these Terms and Conditions does not constitute a waiver of those rights in the future. The User understands and agrees that their personal data, including debit/credit card details, transmitted over the Internet may be susceptible to misuse, hacking, theft, and/or fraud. NPS OMR and the Payment Service Provider(s) have no control over such matters. While reasonable care has been taken to protect the information transmitted by the User, NPS OMR does not guarantee that the use of its Services will be free from theft or unauthorized use of data over the Internet.

NPS OMR, the Payment Service Provider(s), and their affiliates are not liable for any failure of performance, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, computer viruses, communication line failures, theft, destruction, unauthorized access to, alteration of, or use of the information on the website.

The User may be required to create a User ID and Password to register and/or use the Services provided by NPS OMR on the website. The User agrees to keep their User ID and Password confidential and to change the password when necessary
